Membership Contract

 

Definitions

This Agreement is made and entered into by and between findbroker.com.au, trading as FindBroker Pty Ltd (FindBroker) and the Mortgage Broker (You). The Agreement shall
become binding once You accept this Agreement below.

1. Confirming your agreement

An agreement is established between You and FindBroker only after you have confirmed your subscription and FindBroker has accepted it. Your agreement with FindBroker is valid
only if these two terms are met.

The terms and conditions, as well as the agreement between You and FindBroker, have a priority over what you may be told over the phone by a FindBroker employee.

The terms and conditions, as well as the agreement between You and FindBroker are secondary to a written confirmation issued by a FindBroker employee.

2. Paying a signup fee

You need to pay a signup fee when you join or renew your subscription with FindBroker. This fee is listed in your membership agreement. We cannot refund the fee, even if you
cancel during your comfort guarantee period.

3. Understanding FindBroker’s rights

If FindBroker does not enforce our agreement rights at any time, it does not mean it has waived those rights, no matter how long they go unenforced. If there is a miscalculation in
your membership agreement, FindBroker reserves a time frame of 5 days after the agreement is signed to correct it.

4. Using your comfort guarantee

You can cancel your agreement during your comfort guarantee period within 7 days from when you confirm your initial agreement. To cancel your membership, please send an email
to FindBroker at: support@findbroker.com.au. We will then cancel your agreement and refund your initial payment, less your signup fee. This is only applicable for new membership agreements.

5. Membership payment

You many choose to pay for your membership in 12 monthly installments or as a one-off annual payment. If you have a monthly subscription, the number of payments is 12 payments
per annum.

Your membership is activated as soon as you send a completed application form and payment to FindBroker. A receipt will be issued upon receipt of payment.

Your FindBroker membership will commence on the date when your application is accepted and it will be available for a full year. The membership is automatically renewed after one
year. FindBroker will automatically debit your membership fees from your nominated account to renew your subscription.

An invoice will be sent to you before your membership renewal date, which is payable prior to your renewal date for membership fees paid annually.

7. Failure to pay

Annual Payments:

Membership fees are due annually on the date and month in which the member joined Findbroker. Membership benefits will be restricted for all non-financial
members. Membership will officially lapse 1 months after the renewal due date. If an individual’s membership does lapse that individual must not use any Findbroker professional
designation after their name or claim to be a member of Findbroker.

Monthly Payments:

Membership fees are due on the same day each month on which the member joined FindBroker. You will be liable for all subsequent costs incurred in recovering any outstanding debt. Membership benefits will be restricted for all non-financial members. Membership will officially lapse 14 days after the renewal due date.

If an individual’s membership does lapse, that individual must not use any Findbroker professional designation in association their name or claim to be a member of Findbroker.

Failure to pay annual and monthly fees will incur an interest rate of 9.5% p.a or 0.79% per month.

8. Cancellation/refund policy

Annual Payments:

There is no refund of any membership fees should You cancel your membership at any stage during your membership year.

Monthly Payments:

Should you elect to pay your annual membership via monthly direct debit, your membership will be renewed automatically unless your membership is cancelled by You via written notice to FindBroker at least 28 days prior to the beginning of your new annual membership term. If You wish to cancel Your monthly membership within the first
12 months, You will be liable to pay a $69 cancellation fee. After the first 12 months, there is no cancellation fee; however, you are required to give 28 days written notice to support@
findbroker.com.au of Your intention to cancel.

We can cancel your membership without warning if you behave in a way that is risky or seriously inappropriate, such as:

You may not transfer your account to any other person.

11. Upgrading membership

Members may apply to upgrade their membership by completing the relevant upgrade form.

12. Changes to terms and conditions

Findbroker is free to unilaterally change the membership terms and conditions without giving further notice to the individual member. Such changes will, unless otherwise stated,
take immediate effect. Findbroker will publish changes to the terms and conditions on its website. However, members are responsible for keeping themselves updated in relation to
any changes to the terms and conditions.

We reserve the right to increase your fees at any time after the minimum period of your agreement has ended. We will make a reasonable effort to tell you about this at least 28
days beforehand by writing to the address you last gave us (which may be an email address). We will consider that you have received our letter or email on the second business day
after it is sent.

13. Paying GST

All agreement fees include goods and services tax (GST). Your fees will change in line with any government GST rate changes, even if you are in your minimum term.

14. Welcome feedback

support@findbroker.com.au. You will hear from us within 5 business days .

Governing Law

This Agreement shall be governed and construed in all respects in accordance with the laws of New South Wales, Australia.

Legally Binding

This is a legally binding contract. By accepting this agreement You acknowledge that You have read, accepted and agreed to be bound by these Terms and Conditions.

FindBroker is committed to providing you with the best possible customer service experience. FindBroker deals with information privacy in accordance with the Privacy Act 1988
(Cth) and the Australian Privacy Principles (APPs) set out in the Privacy Act. We also comply with the Spam Act 2003 (Cth) which imposes restrictions on sending emails and other
types of commercial electronic messages.

Collection of your personal information

There are many aspects of the site which can be viewed without providing personal information, however, for access to future FindBroker customer support features you are
required to submit personally identifiable information. This may include but not be limited to a unique username and password, or provide sensitive information in the recovery of
your lost password.

We collect and hold:
your contact details, such as office address, home address, telephone numbers and email address;
your personal details, such as date and place of birth, gender, qualifications, titles, whether or not you are Aboriginal or a Torres Strait Islander, the languages you speak;
your browsing history on the FindBroker website and FindBroker Apps;
any financial information to the extent that it is relevant to our functions and responsibilities under, and authorised by, the relevant legislation;
and records of your communications and other interactions with us.

In this Privacy Policy we refer to this as your personal information.

Sharing of your personal information

We may occasionally hire other companies to provide services on our behalf, including but not limited to software development, IT and customer support or processing transactions.
Those companies will be permitted to obtain only the personal information they need to deliver the service. FindBroker takes reasonable steps to ensure that these organisations
are bound by confidentiality and privacy obligations in relation to the reaction of your personal information.

For each visitor to reach the site, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. writing for security reasons. FindBroker reserves the right to charge a fee for searching for, and providing access to, your information on a per request basis.
